A Labor Day weekend accident led to the hospitalization of a 3-year-old child from Newark, NJ after he fell from a second-story window at his family apartment located on Columbia Avenue. The family residence did not appear to have any child safety bars on the windows. The 3 year old suffered head injuries and was taken to the local trauma center at University Hospital in Newark,NJ.

Both the New Jersey Administrative Code and the Newark Municipal Housing Code mandate that landlords and owners of rental housing units are responsible for installing and maintaining window guards on rental apartments and public hallways in which a child between six months and 10 years of age resides.

Landlords must be required to survey their tenants on a regular basis so as to determine if there are children on the premises so as to avoid such unnecessary and serious injuires to our children.
